“Impeach him now!” I yell – “Pssst – Did you know that executive orders that create laws are unconstitutional?” I whisper.
I’ve been calling my representatives…
Congressman Glenn Grothman, and Senators Tammy Baldwin, and Ron Johnson.
I wish I could say that I’ve been calling them daily, or hourly but just like the typical American I don’t have time for that. (That’s why we have representatives anyway, so we don’t have to get involved in the day-to-day.) But I have been calling. I’ve even gone so far as to call my state representatives… the ones who don’t have power outside of the state of Wisconsin.
I struggle to understand why the representatives my state has elected to carry out business on our behalf in Washington DC do not seem to feel called to step in and stop the abuse of power. So, I’ve begun to wonder, am I actually understanding the Constitution? Is there something I don’t quite understand? Granted I am much further in the dark than I could be at this point, but I think a few things are clear… The presidential actions by this administration are in direct violation of the constitution and therefore impeachable on the basis of treason.
Whoa Whoa Whoa – Impeach? Isn’t that extreme?
Isn’t there precedent for Executive Orders. Well, of course, there’s precedent – because for some unknown reason, Presidents before Trump have also used executive orders to decree and make laws. Since 1957 there have been 6,790 executive orders issued [https://www.federalregister.gov/presidential-documents/executive-orders.] I spent about 2 hours looking through them to find the first executive order that created a law, and had to move on to other things.
The fact of the matter is that presidents in the last several decades have been using the “executive order” power to create laws that are designed for citizens. When in fact, the Presidents only power is to ensure the constitution is carried out through executive agencies. The president has no power over citizens of the United States outside the laws that Congress creates. I must ask why, for decades, has the American public been imposed upon by laws that our congressional seats did not craft, nor pass?
It’s continuing to get worse.
Despite the fact that Executive Orders that create laws are unconstitutional they continue to happen, but what’s worse is that they are creating laws that are unconsitutional. These Executive Orders are not just blatant attempts at making laws, but blatant attempts at undercutting the constitution itsself. Attempts to dismantle power and to throw our country into chaos and in-fighting. So, when one man abuses power and takes himself to be King, we must take up issue with that behavior and apply the checks and balances granted in the constitution to ensure the survival of our constitution.
It’s time to put the foot down.
To All of Congress:
Stop allowing the president to usurp YOUR constitutional power. Presidents before this one should not have been using their power to issue law, either. However we can’t change the past. Now… now you can do something about it and to allow it to continue is to be complicit in the overreach. Because we can’t go back and fix our prior follies, we MUST provide warning to future presidents who may decide to use their position to claim power.
As representatives, you must impeach this president or remove him under the 25th Amendment. And not just this president but impeach the next one who does it and the next one after that. Article 2 section 1 only gives the authority of the President to issue executive orders when he’s executing the laws YOU, Congress, have written. While there is precedent for this behavior it has gone UNCHECKED by Congress, so now it’s time to check it. It is time for YOU, Congress to stand up and do the right thing.
Under what grounds should you Impeach?
It is apparent to me, and millions of other Americans that the President either does NOT understand his duty under the Constitution or that he is intentionally attempting to dismantle the Constitution. The first is indefensible as stupidity is not an excuse for not abiding by your ONE Job – especially when it’s your second term. This makes the treason clause available to you even if he has no clear intent to dismantle it. If the reason, however, is that the president is issuing these executive orders in an attempt to create new laws or circumvent the ones in existence, then he is trying to dismantle the constitution. In that case, my friend, He has acted against the constitution and it is blatantly TREASON. You should immediately be beginning the impeachment process.
This is not his only impeachable offense in THIS term, he’s been touting the idea that he does not have to listen to the judiciary branch for several months, and under direct orders to stand down, has directly disobeyed those orders. The founding constitutional ratificants knew that they did not want a king in office nor did they want a federal government that would be too powerful and yet, here we have one… If unchecked, what is to stop him from declaring himself the only true power in the US? With what happened on January 6th, what makes any of us think that he will just let go of power peacefully? I implore you that he wont – at some point he was selling Trump 2028 hats on his website – so under what grounds does he become enough of a threat for you to impeach?
But can we impeach if it is genuine ignorance?
I conclude that with the advisory staff and legal staff at the whitehouses disposal, it most likely is NOT ignorance, however, if it is – it does not save him from answering you about such a situation. If you impeach him and conclude that he really just did not know – I propose that you present a bill requiring any future president to pass a test on the Constitution BEFORE taking the oath of office. From November to January, they shall learn their constitutional duties before taking office. This ensures that in the future there should be no question AND if you can write the law to directly effect the president immediately, then do so.
Additionally, Please Read. (Copied Straight from the Google machine.)
“The principle of “ignorance of the law is no excuse” (ignorantia juris non excusat) holds that people are generally expected to know and understand the laws they are subject to, and a claim of ignorance is not typically sufficient to avoid criminal or civil liability.”
Impeach, or at least do something…
Honestly, either of these roads would satisfy my desire to see my representatives do something… BUT – Can you PLEASE DO SOMETHING!? I have heard crickets from you, despite it being YOUR JOB to be a check and balance from the abuse of power and overreach of the executive branch. You do Represent Us, don’t you??? Isn’t it your job to represent the people of Wisconsin? To defend the Constitution?
I remind each of you of your oath: “I do solemnly swear (or affirm) that I will support and defend the Constitution of the United States against all enemies, foreign and domestic; that I will bear true faith and allegiance to the same; that I take this obligation freely, without any mental reservation or purpose of evasion; and that I will well and faithfully discharge the duties of the office on which I am about to enter. So help me God.”
A Message to my representatives directly,
I’d like to see you support and defend the Constitution – just please stand up and get loud… To Tammy Baldwin who recently made an address about the president. You talk about Broken promises but that’s not enough – this isn’t about broken promises – it’s about broken oaths – it’s about high crimes and treason – and at the VERY LEAST It’s about the inability to discharge the powers and duties of the said office… How can you discharge the powers and duties of the office if you don’t know what they are??? I recognize that Starting the process of Impeaching Trump didn’t go over well the first two times, but this time inaction will cost us our country. (Also, don’t they say that the third times the charm?)
To Ron & Glenn… If this was a Democrat doing this… if this is a future Democrat in office – how will you protect the office? It’s time to send a clear message to ANY Current or FUTURE presidential nominees and to our commander-in-chief that we WILL NOT TOLERATE the continued erosion of the separation of powers or of the offices as appointed by the Constitution. If I am misunderstanding the constitution – PLEASE educate me – send me a link to where it says that this is okay so that I can understand. If I am correct in knowing that the executive branch is participating in blatant overreach – then you MUST impeach – because when a Democrat comes into office and does the same thing – you won’t find this so cathartic.
This isn’t about politics and ideals or democrats and republicans – it’s about governmental operations and design. It’s about doing the ONE job you took an oath to do. It’s about America! In case you forgot: House Oath and Senate Oath.
A message to our citizens:
It’s time for you to do something too. The time to sit back and let “representatives” take the burden of protecting our liberties is over. Especially when none of them seem to actually represent us. Taxation without representation caused outrage from our founding fathers, and yet most of our society still sits back and says “Well, what can I do?”
- Start by Emailing and calling your representatives.
- Learn about the Constitution. For real – for most of us it’s been years since we took history – and NOW in the present moment so many people don’t seem to understand what the Constitution is designed to do. Learn about the Constitution, as it’s written. Learn about what the federalists and the anti-federalists wanted you to know.
- Learn about what your representatives are actually doing. The House and Senate both put a list of all legislation that they take up or put forth on the websites. Take a look.
- Ask to shadow your reps, and ask to ride along to better understand their process.
- Get involved in your local community. Talk to people and ask questions. Don’t presume to know what people need, find out.
- Get involved with your elections.
- Get involved with your local government (or state or federal… just get involved!) (This looks like attending meetings, or maybe even running for an office.)
- VOTE – in the next election. Exercise your right to vote and prepare early. Don’t get stuck with some of the most recent legislation that may prevent you from voting if you’ve changed your name.
Imperfect action is better than inaction:
If you’re like me you may feel like you need to know more. Or maybe you feel that you don’t have enough experience. However, I argue that our country’s founders didn’t have experience either – they didn’t know any more than what they thought they knew and boy did they make some mistakes. As I’ve leaned into action, I’ve learned that the answers to our questions either reveal themselves or challenge us to find solutions to find them. Believe it or not, you learn just like at any job as you go.
Personally, I’m leaning toward the fact that the group that drafted our founding documents were actually just a bunch of pissed-off landowners who didn’t know much about the government other than what they didn’t like about its actions. I think, honestly, that describes a large majority of us… maybe most of us aren’t landowners but no problem, you don’t need to own land to take action for a better community.
After I wrote this blog post I learned that a representative has already put through a bill to impeach the president. Find more information here: https://www.congress.gov/bill/119th-congress/house-resolution/353/text
